Export controls

What are they?

Export controls prohibit the unlicensed export of certain commodities or information, usually for security or trade protection reasons. It is important to have these controls, particularly for diamonds and uranium, to ensure that goods originating from Australia are used and transported appropriately.

Export controls are provided for under the Customs (Prohibited Export) Regulations 1958 and are designed to be consistent with Australia’s national interests and international obligations.

How is the department involved?

The department administers three export controls:

  • Rough diamonds can only be exported to countries that participate in the Kimberley Process Certification Scheme, an international effort to eliminate the trade of conflict diamonds. Each diamond shipment leaving Australia must be accompanied by a Kimberley Process Certificate which certifies that the rough diamonds are from legitimate sources and are not involved in funding conflict.
  • Uranium and related nuclear materials (controlled materials), including tantalum and minerals sands containing monazite, are subject to Australia’s non-proliferation obligations and safeguards regime. Export of these goods is prohibited unless permission is obtained from the Resources Minister or an authorised person. Further information is at the uranium and controlled ores export page.
  • Liquefied Natural Gas (LNG) exports may be restricted where the Resources Minister triggers the Australian Domestic Gas Security Mechanism (ADGSM). The ADGSM allows the Government to impose export controls on LNG exporters where there is deemed to be a shortfall of gas supply in the domestic market.
